01 Privacy Protocol (GDPR)
1.1 Data Controller Information

1.2 Categories of Personal Data Collected
We collect and process the following categories of personal data in accordance with Article 6(1) of the EU General Data Protection Regulation (GDPR):
- Identity Data: Full name, username, or similar identifiers
- Contact Data: Email address, telephone numbers, billing and delivery addresses
- Technical Data: Internet Protocol (IP) address, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform
- Usage Data: Information about how you use our website, products, and services
- Marketing Data: Your preferences in receiving marketing from us and your communication preferences
1.3 Legal Basis for Processing
We process your personal data only when we have a legal basis to do so. The legal bases include:
- Consent (Article 6(1)(a)): Where you have given clear consent for us to process your personal data for a specific purpose
- Contract (Article 6(1)(b)): Where processing is necessary for the performance of a contract with you
- Legitimate Interests (Article 6(1)(f)): Where processing is necessary for our legitimate interests, provided these are not overridden by your rights
- Legal Obligation (Article 6(1)(c)): Where we need to process your data to comply with a legal obligation
1.4 Data Retention Periods
We retain your personal data only for as long as necessary to fulfill the purposes for which it was collected, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure, and applicable legal requirements.
1.5 Your Rights Under GDPR
Under the General Data Protection Regulation, you have the following rights:
- Right of Access (Article 15): Request access to your personal data
- Right to Rectification (Article 16): Request correction of inaccurate personal data
- Right to Erasure (Article 17): Request deletion of your personal data
- Right to Restrict Processing (Article 18): Request restriction of processing of your personal data
- Right to Data Portability (Article 20): Request transfer of your personal data
- Right to Object (Article 21): Object to processing of your personal data
- Right to Withdraw Consent: Withdraw consent at any time where we rely on consent to process your data
1.6 Data Transfers
We may transfer your personal data to countries outside the European Economic Area (EEA). When we do so, we ensure appropriate safeguards are in place, including Standard Contractual Clauses approved by the European Commission, to ensure your data receives an adequate level of protection.
1.7 Data Security
We implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk, including encryption, pseudonymization, regular testing and assessment, and measures to ensure the ongoing confidentiality, integrity, availability, and resilience of processing systems.
03 Refund Matrix
3.1 Refund Eligibility
Refunds are evaluated on a case-by-case basis in accordance with Belgian consumer protection laws and EU Directive 2011/83/EU. The following conditions apply:
- Services not yet commenced may be eligible for a full refund within 14 days of purchase
- Services in progress are subject to pro-rata refund based on completion milestones
- Completed services are not eligible for refund unless delivered specifications were materially different from agreed requirements
3.2 Refund Process
To request a refund, contact [email protected] with your project reference number and reason for the refund request. We will acknowledge receipt within 48 hours and provide a decision within 14 business days.
3.3 Refund Methods
Approved refunds will be processed using the original payment method. If this is not possible, we will arrange an alternative refund method in consultation with you. Processing times may vary depending on your payment provider.
3.4 Dispute Resolution
If you are dissatisfied with our refund decision, you may escalate your complaint to the Belgian Economic Inspectorate (Inspection économique) or seek resolution through the European Online Dispute Resolution platform at https://ec.europa.eu/odr.
04 Terms of Operations
4.1 Acceptance of Terms
By accessing and using the services provided by FluxAnchorLabs, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our services.
4.2 Service Scope and Delivery
All services are delivered according to the specifications outlined in the respective service agreement or statement of work. FluxAnchorLabs reserves the right to modify service specifications with prior written consent from the client.
- Project timelines are estimates and may be adjusted based on scope changes or unforeseen technical challenges
- Deliverables remain the intellectual property of FluxAnchorLabs until full payment is received
- Source code and design assets are transferred to the client upon project completion and final payment
4.3 Payment Terms
Payment terms are as follows unless otherwise specified in the service agreement:
- Invoices are payable within 30 days of issue date
- Late payments incur a statutory interest rate of 8% per annum plus administrative costs
- Services may be suspended if payment is more than 15 days overdue
4.4 Intellectual Property
All intellectual property rights in deliverables are transferred to the client upon full payment. FluxAnchorLabs retains the right to use anonymized case studies and general methodologies for marketing purposes unless explicitly prohibited in writing.
4.5 Limitation of Liability
FluxAnchorLabs shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the total amount paid by the client for the specific service giving rise to the claim.
4.6 Governing Law and Jurisdiction
These terms are governed by Belgian law. Any disputes shall be subject to the exclusive jurisdiction of the courts of Brussels, Belgium. EU consumers retain their statutory rights under applicable consumer protection legislation.
4.7 Amendments
FluxAnchorLabs reserves the right to amend these terms at any time. Material changes will be communicated via email to registered clients at least 30 days before taking effect. Continued use of services after changes constitutes acceptance of the amended terms.
